Senate Dems Elect Bewley Minority Leader

Meeting by videoconference, Senate Dems today unanimously elevated Janet Bewley, of Mason, to minority leader.
Bewley, who had been the assistant minority leader since 2017, replaces Sen. Jennifer Shilling. The La Crosse Dem stepped down as minority leader today because she isn’t seeking reelection this fall.
Sen. Janis Ringhand, D-Evansville, was unanimously elected to replace Bewley as the assistant.
Meanwhile, Sen. Mark Miller, D-Monona, remains caucus chair.

Evers Administration Has Until Tuesday to Respond to GOP Lawsuit

The state Supreme Court is giving the Evers administration until Tuesday to respond to a lawsuit GOP legislative leaders filed seeking to prevent enforcement of the latest stay-at-home order.
The court set filing deadlines late yesterday after Republicans filed the suit. As part of the action, GOP lawmakers want the Supreme Court to stay the proposed injunction for six days to give the Evers administration time to promulgate emergency rules, which are subject to legislative oversight.
The court’s order also gives non-parties until April 29 to file briefs, while GOP lawmakers face an April 30 deadline to respond to the filing from the Evers administration.

GOP Lawmakers Seek Stay of Latest Evers Stay-at-Home Order

GOP lawmakers today asked the state Supreme Court for an injunction preventing the Evers administration from enforcing its latest stay-at-home order, arguing Health Services Secretary Andrea Palm exceeded her authority in issuing the new directive.
The Legislature asked the Supreme Court to hear the suit directly and issue an injunction preventing enforcement of the new stay-at-home order, arguing it exceeds the department’s authority. The suit also argued the Evers administration inappropriately went around the Legislature in issuing the order.
GOP lawmakers also asked for the court to stay the proposed injunction for six days to give DHS time to promulgate a new emergency rule. The suit argued that would “fairly accommodate the parties’ mutual interest in preserving the status quo and ensuring no disruption to the State’s efforts to control the spread of COVID-19 while DHS undertakes steps to comply with all applicable statutes.” Emergency rules are subject to legislative review.
